The federal bioengineered food disclosure system is a recordkeeping and labeling rule, not merely a logo requirement. Companies need to know whether a food is covered, which disclosure method they are using and what evidence supports the decision.

Who the USDA standard covers

USDA’s Agricultural Marketing Service says the National Bioengineered Food Disclosure Standard covers food manufacturers, importers, and retailers that package and label food for retail sale or sell bulk food items, subject to specified exceptions. Restaurants and similar retail food establishments are excluded, and very small food manufacturers are also exempt.

Disclosure can appear in several forms

USDA allows multiple disclosure methods, including on-package text, a USDA-approved symbol, electronic or digital disclosure, and text-message disclosure. Small manufacturers and very small packages have additional options under the standard.

The List of Bioengineered Foods is a starting point

AMS maintains a List of Bioengineered Foods. Foods on the list generally require disclosure unless records demonstrate that the food or ingredient is not bioengineered under the standard. That makes supplier documentation and formulation records an important part of the compliance file.

Records are part of the rule

USDA says covered entities must maintain customary or reasonable records sufficient to establish compliance, and those records generally must be retained for two years after the food is sold or shipped. Examples include invoices, bills of lading, supply-chain records, organic certifications, process verifications and laboratory test results.

Operational workflow
  • Map ingredients against the current AMS list.
  • Collect supplier documentation before artwork approval.
  • Select one disclosure method and apply it consistently.
  • Keep records connected to the exact formula and package version.
  • Reassess when suppliers, ingredients or processing methods change.
